What should I check about consent before I upload past customers to ad platforms?
Short answer
Check your lawful basis and notice, handle regions separately, remove objections, send the minimum, follow each platform's rules, and keep a record.
Check that you have a lawful basis for using that data for advertising, that your privacy notice told people, and that you have removed anyone who objected. This is a question for your own legal adviser. A tool can send the data. It cannot decide that you may.
Start with what you told people. When customers gave you their email, what did your notice say about use for marketing and advertising? If the notice never mentioned it, or the data was collected for a different purpose, using it to match on ad platforms may not be covered.
Then separate the regions. Rules differ across the EU and UK, the US states, and elsewhere. A list with customers from several places may need different handling. Do not assume the strictest or the loosest rule applies to all.
Respect objections. Anyone who unsubscribed, opted out, or asked to be deleted should be removed before you build the file. Check the list against your suppression records, not only your marketing tool.
Minimise what you send. Platforms need an email or phone to match. You do not need names, addresses or purchase details unless they improve matching and you have a basis to use them. Send the least you need.
Check each platform's own rules. Meta, Google and TikTok each publish terms and policies about customer data, and they require you to confirm you have the right to use it. Read them and keep a record of your confirmation.
Think about sensitive categories. If your business touches health, finance, or other sensitive areas, ask your adviser before using any customer list for advertising, and consider whether it is wise at all.
Keep a record. Note what list you used, when, what basis you relied on, and what you excluded. If a question comes up later, a simple record helps.
